THE BEST BOAT PARIS
ARTICLE 1 – COMPANY IDENTIFICATION
The company THE BEST BOAT PARIS, hereinafter referred to as the “Company”, carries out an activity of organizing and marketing private tourist boat cruises on the Seine River, in Paris, France.
These General Terms and Conditions of Sale (GTC) govern, without exception, all contractual relationships established between the Company and any natural or legal person making a reservation, hereinafter referred to as the “Client”.
ARTICLE 2 – PURPOSE AND SCOPE OF APPLICATION
These GTC aim to define the conditions of reservation, payment, performance, modification, cancellation, and liability relating to the private river cruises marketed by the Company.
They apply to any reservation, regardless of the channel used (website, email, WhatsApp, partners, or intermediaries).
The confirmation of a reservation implies full, complete, and unconditional acceptance of these GTC, which prevail over any other document or communication.
ARTICLE 3 – DEFINITIONS
For the purposes of these GTC, the following terms shall have the meanings set out below:

Cruise: a private tourist service provided by boat on the Seine River.

Reservation: the conclusion of a contract for a cruise on a specific date and time.

Group: all passengers included in the same reservation.

Vessel: the boat used to carry out the cruise.

Force Majeure: any unforeseeable, unavoidable event beyond the Company’s control, as defined by French case law, including but not limited to weather conditions, administrative decisions, navigation restrictions, strikes, demonstrations, accidents, floods, or low water levels of the Seine River.
ARTICLE 4 – RESERVATIONS
4.1. Reservations may be made via the Company’s official website or through direct contact via its official communication channels.
4.2. A reservation shall only be considered final and contractually binding after:
-
full or partial payment as required; and
-
express confirmation by the Company.
4.3. The Company reserves the right to refuse any reservation that does not comply with the conditions set out in these GTC.
4.4. The Client is solely responsible for the accuracy of the information provided at the time of reservation.
ARTICLE 5 – VESSEL CAPACITY
5.1. The maximum capacity of the vessel is set at twelve (12) persons, including adults, children, and infants.
5.2. Each package includes up to six (6) passengers. Additional passengers are subject to an additional fee.
5.3. Exceeding the authorized capacity is strictly prohibited for safety reasons and in compliance with French inland navigation regulations.
5.4. In the event of non-compliance, the Company reserves the right to refuse boarding, with no refund being due.
ARTICLE 6 – PRICES AND PAYMENT
6.1. Prices are expressed in euros (€) and correspond exclusively to the service described at the time of reservation.
6.2. Additional services, customizations, or specific requests may be subject to additional charges.
6.3. Payment must be made according to the methods and deadlines indicated by the Company.
6.4. No reservation will be maintained without payment in accordance with the agreed conditions.
ARTICLE 7 – PERFORMANCE OF THE CRUISE
7.1. The cruise is carried out on the agreed date and time, except in cases of force majeure.
7.2. The Client must arrive at the boarding location within the indicated time. Any delay may result in:
-
a reduction in the duration of the cruise; or
-
cancellation of the cruise, with no right to a refund.
7.3. The cruise itinerary is not contractually guaranteed and may vary depending on:
-
navigation conditions;
-
river traffic;
-
restrictions imposed by competent authorities, in particular Voies Navigables de France (VNF);
-
weather conditions;
-
operational constraints.
7.4. Any reference to monuments, locations, or tourist sites is provided for indicative purposes only and does not constitute a contractual obligation.
ARTICLE 8 – WEATHER AND NAVIGATION CONDITIONS
8.1. The Seine River is subject to variations in water level, current, temporary navigation bans, floods, low water levels, and administrative decisions.
8.2. The Company cannot be held liable for any modifications, reductions, or cancellations of the cruise resulting from these conditions.
8.3. In the event of impossibility of navigation, the Company may offer:
-
rescheduling of the cruise; or
-
a full or partial refund, depending on the circumstances.
ARTICLE 9 – ONBOARD CONDUCT
9.1. All passengers must strictly comply with the crew’s instructions.
9.2. Any behavior likely to compromise the safety of persons or the vessel is prohibited.
9.3. Children remain under the full responsibility of the accompanying adults.
9.4. Any damage caused to the vessel or its equipment shall be charged to the responsible Client.
9.5. The Company reserves the right to immediately interrupt the cruise, without refund, in the event of inappropriate behavior.
ARTICLE 10 – CANCELLATION BY THE CLIENT
10.1. Cancellation and refund conditions are defined in the Cancellation Policy applicable at the time of reservation.
10.2. Cancellations made outside the specified deadlines do not give rise to any refund.
10.3. Failure of the Client to appear at the agreed time (no-show) results in the total loss of the amounts paid.
ARTICLE 11 – CANCELLATION OR MODIFICATION BY THE COMPANY
11.1. The Company may cancel or modify the cruise in the event of:
-
force majeure;
-
administrative restrictions;
-
technical incidents;
-
weather conditions incompatible with safety.
11.2. In such cases, the Company’s liability is strictly limited to:
-
proposing a new date; or
-
refunding the amounts paid, without any additional compensation.
ARTICLE 12 – LIABILITY
12.1. The Company is subject to an obligation of means, not of result.
12.2. The Company cannot be held liable for:
-
loss of or damage to personal belongings;
-
delays attributable to external factors;
-
events beyond its control.
12.3. The Client participates in the cruise at their own responsibility.
ARTICLE 13 – INSURANCE
The vessel is covered by insurance in accordance with the requirements of French legislation applicable to tourist inland navigation.
ARTICLE 14 – PERSONAL DATA
14.1. Collected data are processed in accordance with the General Data Protection Regulation (GDPR).
14.2. The Client has the right to access, rectify, and delete their personal data, under the conditions provided by law.
ARTICLE 15 – INTELLECTUAL PROPERTY
All content on the The Best Boat Paris website is protected by intellectual property rights. Any reproduction is prohibited without prior authorization.
ARTICLE 16 – LANGUAGE AND PREVAILING VERSION
These GTC may be translated into other languages.
In the event of any discrepancy in interpretation, the French version shall prevail.
ARTICLE 17 – APPLICABLE LAW AND JURISDICTION
17.1. These GTC are governed by French law.
17.2. Any dispute shall be submitted to the competent courts of France, unless mandatory legal provisions provide otherwise.
